The Urgency of the Existence of Arbitration among the Business World in Medan Municipality

Introduction

In today's fast-paced business world, disputes are inevitable. However, resolving these disputes in a timely and efficient manner is crucial for the success of any business. Arbitration has emerged as a popular alternative dispute resolution (ADR) method, offering a faster and more cost-effective solution compared to traditional litigation. Despite its recognition, many business actors in Medan Municipality are not accustomed to using arbitration as a method of resolving their business disputes. This study aims to explore the existence of an arbitration institution, ranging from making an arbitration clause to efforts to resolve business disputes through arbitration.

Background

Arbitration is an alternative institution for dispute resolution that can be utilized by business actors in the private and commercial sectors. It provides a neutral and impartial platform for parties to resolve their disputes, thereby reducing the risk of lengthy and costly litigation. However, even though its existence is recognized, many business actors in Medan Municipality are not familiar with arbitration institutions. This lack of understanding can lead to a low utilization rate of arbitration services, resulting in a higher reliance on traditional litigation.

Methodology

This study employed an analytical socio-juridical approach to explore the existence of an arbitration institution in Medan Municipality. The study was conducted in the Medan Municipal Chamber of Commerce and Industry (Kadin), which has 954 members of business actors. Of these, 50 respondents were chosen through purposive sampling, consisting of 40 private business actors, 5 BUMN/BUMD, and 5 cooperatives. Primary data was obtained through direct interviews and literature studies, then analyzed with a juridical qualitative approach.

Results

The results of this study showed that although the majority of business actors were familiar with arbitration institutions, their understanding of arbitration was still low. This resulted in arbitration not being a first choice in resolving business disputes. The form of arbitration institutions most in demand by business actors was an arbitration institution that provides mediators to resolve disputes. Several factors that became a barrier in the use of arbitration services included a lack of understanding of arbitration institutions, lex arbitrate regulations that were considered out of age, and a limited number of professional arbitrators.

Discussion

The findings of this study highlight the importance of increasing awareness and understanding of arbitration institutions among business actors in Medan Municipality. By providing education about the laws and regulations related to arbitration, holding seminars on arbitration, publishing information in the mass media, and issuing bulletins about arbitration, parties can make various efforts to increase awareness and understanding of arbitration. It is hoped that with the new arbitration law, the arbitration institution can be utilized optimally, so that the settlement of business disputes among business actors in the Medan Municipality can achieve satisfying results.

Conclusion

The existence of arbitration in the business world has a high urgency, given the increasingly complex and faster business dynamics. By understanding and utilizing arbitration, business actors will not only get a fast and efficient solution in resolving disputes, but will also increase trust between business people. Therefore, it is essential for business actors in Medan to make arbitration a viable alternative in the process of resolving their business disputes.

Based on the findings of this study, the following recommendations are made:

This study has several limitations. Firstly, the study was conducted in Medan Municipality, which may not be representative of other regions. Secondly, the study only focused on business actors in the private and commercial sectors, and did not include other sectors such as government and non-governmental organizations. Finally, the study only explored the existence of an arbitration institution and did not examine the effectiveness of arbitration in resolving business disputes.
